This memorandum has been prepared for distribution to more thanone congressional office. 

This memorandum provides an analysis of the effect of the Supreme Court’sdecision in National Federation of Independent Business v. Sebelius onthe Medicaid expansion in the Affordable Care Act (ACA). First, we providea summary of the Court’s decision regarding the constitutionality of the ACA Medicaidexpansion. Then, using the framework of the Court’s decision, which limited theability of the federal government to withhold all federal Medicaidmatching funds unless states comply with the ACA Medicaid expansionrequirements, we address selected questions regarding implementation of the Medicaidexpansion provision.
